1. Agreement to Terms

By downloading, installing, or using the Wappi mobile application and related services (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Wappi (“we,” “us,” or “our”).

2. Eligibility

You must be at least 13 years old to use the Service. By creating an account, you confirm that you are at least 13 years of age and that the information you provide during registration is accurate.

If you are under 18, you confirm that you have the consent of a parent or legal guardian to use the Service.

3. Your Account

Registration

To access certain features of the Service, you must create an account by providing a valid email address, choosing a username, and setting a password. You are responsible for maintaining the confidentiality of your account credentials.

Account Security

You are responsible for all activity that occurs under your account. You agree to notify us immediately at support@wappi.co.ke if you become aware of any unauthorised use of your account.

Account Accuracy

You agree to provide accurate and complete information when creating your account and to keep your account information up to date.

4. The Service

What We Provides

Wappi is a plans discovery platform that aggregates and curates information about events, activities, and experiences happening in Nairobi, Kenya. The Service allows you to browse, search, save, and share plans.

Content Accuracy

Plans and event information displayed on Wappi are aggregated from third-party sources. While we make reasonable efforts to ensure accuracy, we do not guarantee that information about any plan; including dates, times, prices, venues, or availability, is accurate, complete, or current.

You should always verify details directly with the event organiser or venue before making plans based on information found on Wappi.

The Service may contain links to third-party websites, ticketing platforms, and venue pages. These links are provided for your convenience. We do not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party sites.

Availability

We aim to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorised access to the Service, other accounts, or our systems
  • Use automated means (bots, scrapers, crawlers) to access or interact with the Service without our written consent
  • Interfere with or disrupt the Service or the servers and networks connected to it
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Upload or transmit viruses, malware, or any other harmful code
  • Harass, abuse, or harm other users of the Service
  • Use the Service to send unsolicited communications or spam

We reserve the right to suspend or terminate your access to the Service if you violate these Terms.

6. Intellectual Property

Our Content

The Service and its original content; including the Wappi name, logo, bird mark, mascot, design elements, and software, are owned by Wappi and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service or its content without our written consent.

Third-Party Content

Event information, venue details, images, and other content displayed on the Service may be sourced from third parties and remains the property of its respective owners.

Your Content

Any content you submit through the Service (such as your profile bio) remains yours. By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content as part of providing the Service.

7. Personalisation

The Service personalises your experience based on your interactions, including plans you view, save, and search for. This personalisation is designed to surface plans that are relevant to your interests.

You can influence personalisation by adjusting your category and neighbourhood preferences in the app. Your preference data is used solely to improve your experience and is handled in accordance with our Privacy Policy.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • Information about plans, events, or venues will be accurate or reliable
  • Any defects in the Service will be corrected

9. Limitation of Liability

To the maximum extent permitted by applicable law, Wappi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Wappi, its officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms.

11. Account Deactivation and Termination

By You

You may deactivate your account at any time through the app’s settings. Upon deactivation, your account data will be retained for 30 days in case you wish to reactivate, after which it will be permanently deleted.

By Us

We may suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our discretion.

Upon termination, your right to use the Service ceases immediately.

12. Changes to These Terms

We may modify these Terms at any time. When we make changes, we will update the “Last Updated” date at the top and, where appropriate, notify you through the app.

Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you should stop using the Service.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Kenya. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wappi regarding the Service and supersede any prior agreements.
